MDJ Has had an accident

MDJ wants me to tell you all that last Sunday whilst on route to Oakdene cafe near Brands Hatch he had a accident.
Riding down the A20 towards Brands he came across a Sunday car boot. Whilst filtering a car indicatored last minute and pulled a right turn. He stood no chance and hit into the side of the car. He has a broken arm, damaged ribs and a mashed back. His bike is a write off. He got taken to hospital in a ambulance and was giving a producer by our loveable boys in blue(my butt). This morning through the post he received a notice of intention to prosicute for dangrous driving.

Poor guy, let him know we all hope he's up and about soon. I'm gonna show my ignorance here, what's a "producer"?

The cops give you one and you get seven days to show them (produce)your documents:MOT, tax, ect.. if you have them all that is. :wink:

Sorry to hear that MDJ, get well soon. You would think by now that people were aware of the phrase "think outside the box", this also applies to drivers of boxes, bunch of jerks.

The Highway Code states the following :-

Manoeuvring. You should be aware of what is behind and to the sides before manoeuvring. Look behind you; use mirrors if they are fitted. When overtaking traffic queues look out for pedestrians crossing between vehicles and vehicles emerging from junctions.
Remember: Observation - Signal -Manoeuvre.


That ia an extract from rules for motorcyclists Paragraph 71. I would therefore assume that they could not prosecute for carrying out a manouvre as described in the Highway Code, although it does not describe it as filtering, I think the operative phrase is when "overtaking traffic queues", which is what you would apperar to have been doing. The Highway code also has rules for drivers, the following is an extract, again from the Highway Code


All mirrors should be used effectively throughout your journey. You should
use your mirrors frequently so that you always know what is behind and to each side of you
use them in good time before you signal or change direction or speed
be aware that mirrors do not cover all areas and there will be blind spots. You will need to look round and check.
Remember: Mirrors - Signal - Manoeuvre


Rule 137 from the Highway code, it also has graphics relating specifically to Motorcyclists, although this relates to moving off, the same should relate to turning, as it states above. Have a look at the link

I was under the impression that the Highway code also formed part of the law, or at least part of the armoury for prosecution under the Road Traffic Laws. It used to as you could be held partly liable for an accident in the previous Highway Code, 1st published around 4 years ago, if you were not wearing a white helmet. I think the MAG + other action groups protested and got the wording changed to the current "white or brightly coloured helmet"

I'm sure someone will tell me it's boll*cks.

You mean a HRT1, horty I always knew it as. I should have guessed that, I've had loads of them.

Really sorry to hear about this, life is sometimes sh1t.

I recently filtered for 84 miles on the M5, only one car pulled out but as my speed was only about 15 mph.....not a problem...but always aware that it is only a matter of time before it happens .

Similar accident

I hit a u-turning car about 2½ yrs back. Bike was a complete write off. I walked away but it turned out that my shoulder was broken, bruised balls (there was a dent in the tank the size of a tennis ball 8O ), bruised ribs & left hand.

The car driver did not indicate or look for traffic behind her. Thankfully I had a witness behind me (fella on a blade) who confirmed that the lady ( :roll: ) did not indicate and manouvered without looking.

She had to accept full liability and I recovered the loss of my zx6-r.

In hindsight - If I was driving slower I could probably have breaked and stopped sooner. (rather then t-bone the car at 30 mph) but this did not take away from the fact that the accident was caused by a careless manouver on the car drivers side.

MDJ, Hope this gives you a bit more convidence that the case will swing your way. If you have witnesses make sure you get their statements ASAP. Get well soon!
