Was in my 1st year and it was a 12month contract, due to expire in Nov this year and them be renewed. Iffy cos I was on a written warning for absence. Will keep records of everything (ta kenif for reminding me). Going 2 CAB tomorrow and will then make decision as to whether to hire employment solicitor to file a case.
Believe several colleagues are about to quit as a result too...

RQ! Just saw your post!

You must've been typing at same time as me......(very slow with one hand)

Spoke to an employment law specialist and as RQ said, under 12months I can't claim unfair dismissal unless I was some kind of minority.

Seems the best I can do is try for proving an illegal deduction or breach of 12 month fixed contract in which case my employers owe me full pay untill my contract was due to end.
In either case I've been advised to wait untill the end of the notice period so that I can claim legal aid because of having no income......

Hi MDJ,
Never met you or anything but, really sorry to hear about the accident.

Hope youre injuries are slowly-but-surely improving. Before you know it, you'll be back on a bike and this whole episode will be 12 months past or 2 years past or whatever.

Tw*ts in cars (female as well as male) are really spoiling the enjoyment of biking on the roads because there's so many of them on the roads now. They just don't look, have crap observations and do stupid, dangerous moves - then to top it all off they ALWAYS blame the innocent victim - ALWAYS.

Hope the case against your ex-employer goes well and I certainly hope the case against the car driver goes well (We can do without these types on the road). Even if you don't win fully, I hope, at worst, she has to accept some of the blame (which I think she will have to as she failed to check behind her before moving away from a standstill)

Can't give you any legal advice, even though I am studying to be a lawyer(!!) as I'm not qualified or experienced enough in this area

AS for the 'Storm may it RIP

(Maybe it's parts can go to other deserving 'Storms around the UK

Who do you work for -private or Public - public/govt employers will swallow the loss and pay you. Private companies have no obligation above contract and ssp of Â£ 70 a week. - Trust me I work for DWP (fraud squad) - undercover so don't tell anyone!

I would suggest you negotiate an early severance deal as your employer may see this as a way out of a potential tribunal which invariably causes publicity. they are usually more afraid of this than anything else. - Imagine the headline: Badly injured local man sacked by uncaring bosses due to motorbike injuries caused by bad driver.

just a thought.......................?

this is it, the amount i can claim for will be maybe 2.5K, too small really for the private company who sacked me, to bother with court for...

as for parts off my bike, recovery place says i was quite thorough in damaging eveything. i havent seen it tho, prolly getting someone to check it out soon..

thanks again for the messages peeps, startin to feel stronger, desperate to jump like a monkey and then cain the butt of a storm..

The whole thing is a joke, it's all about kicking a bloke while he's down. Situations like that are so frustrating when there is not much you can do.

Ah yes it gets better, my bike had undisclosed mods : aftermarket pipes, white stripe on the paint, cromed fittings and braided hoses. A note of these mods were made and sent to my insurers along with the assesment classing my bike as a class B write off.
No offer has been made as they are deciding whether these undisclosed mods will affect the claim.
Yeah Yeah my bad I know but now I'm kinda crappin myself, how bad an effect is this likely to have? Does anyone know ? will I be liable for all costs?

well, chums the saga continues.

strange, my humerus is still not healed. the fragments have just about united but no significant further progress has been made. Soon it'll be classed as a non union and a bone packing procedure may be needed.

It is suggested that my smoking (although not heavy) may have contributed and i must stop even though no guarantee it'll benefit.

Anything you guys know related to this would be apreciated. Do you lot think this may be the time to break the bank and go bupa?

No way, don't consider BUPA as an option. What you need is advice on best local Orthopaedic Surgeon then get referred to him. Don't matter where he is.

Non-union not too good but often stimulation with electrical impules works.

bone graft involes chipping fragments of your own bone from your illiac creast (hip) and inserting between the bone where the non-union occur.
Hip hurts like hell afterwards.

some times bone is taken from a bone bank, ie irradiated bone from someone else (living or dead)

A healthy diet rich in calcium helps bone growth, smoking does delay formation of new bone by inhibiting the function of osteoclasts and osteoblasts ie new bone forming cells. Paul (Senior orthopaedic Nurse)

Get real friendly with one of the nurses, they will usually know from experience which one has a particular interest in upper arm surgery etc.

Might tell you which is crap too !

Tell me which hospital and which consultant you have and I can ask the Surgeons here (nice bunch) if they know anything about your area as they usually travel all around the country.

MDJ got one of the Specialist Registras (SpRs) looking into consultant for you will let you know what he finds out.

Where is the fracture, upper.........near shoulder joint, middle or lower down near the elbow, is either the shoulder or elbow joint damaged,

Do you have any nerve damage ie loss of feeling, pins and needles etc.

all the above affects potential treatment.

Merry Christmass all. sorry i havent been able to get on here for ages. Thanks for comin back to me, the injury is a mid shaft, humeral fracture. Doesnt seem to be any nerve damage, elbow stiff as a result of immobilization.
Will be gratefull for anything you can find out, hope the festivities go well and
