With intake leaks that is going to give you the Carb cough for sure.

still waiting on the carb rubbers to come the noise is really starting to get to me. The revs fluctuate on idle bloke on another forum thinks it could be running to lean.

Well done  And yes that split is for the restrictor, not that you need it. :) It was probably leaking air where the damaged bit is. Either that or the clip was not on tight enough.

Agree, that damage to the rubbers in itself isn't likely to cause these symptoms, so I'd suspect a small air leak in the carb seating somehow.
It's not falling off, it's an upgrade opportunity.

Usually I'd say yes, but as yours is now running nicely I'm tempted to say leave well enough alone.

Be aware there are two types of rings, the early models have a metal ring which has a round hole and doesn't really restrict much. It more for sturdiness. On the later bikes they made the hole in the ring more of a D shape which restricts things slightly as part of the emissions laws or something silly like that.

Here's a pic of the two differences between the earlier and later models.

Leave as it is then, it will give a bit of sturdiness to the rubbers which will help with wear and tear when pulling carbs on and off.
