Question about clutch reservoir washer (top hat)?

You know the rubber top hat thing in the clutch reservoir, when it's inserted into the reservoir should there be clutch fluid inside the 'upside down top hat'? Also, when I remove it it's always kinked, is this normal or do I need a new one and if so where do I get one?

There should only be fluid in the cup .
As the fluid lowers the rubber will lower into the cup .
Whenever I have removed mine it has kinked this is normal .
When refitting it should be in its normal compressed position without kinks .
