Got the new's today Silver is dead :cry:
Total write off, the hole in the clutch cover seem's to be the main problem, because no bit's from the hole have been found mean's the engine has to be stipped and cleaned meaning big labour bill.
I've thought about buying it back but could end up with more trouble than i bargained for.
R I P Silver.

I'm still off work (how long do rib's take to heal 8O )

....Might be worth getting a price off them..If its cheap enough you could buy a cheap Storm and make a good one out of the pair & still have plenty of bits to flog off onto e bay :?:

Dave, I've just been told by a mate of mine that if your vehicle is written off by someone else and the insurance payout is from their insurers and NOT your insurance company, they have no right to take your vehicle, but they often try :!:

May be a phone call to your insurance company or CAB (Citizens Advice Bureau) might be a good idea :!:

Chris, Surely they will still reduce the payout by the salvage valuation of the bike, as your own insurers would do in a buy back siuation?

I got stiffed by my insurers (still on going) with the Domi. They paid out, but as their preferred salvage co. guarantees them 32% of the pre accident value - I had my payout reduced by £832 instead of £600!

Once it's all sorted re 3rd party fessing up, I should get the difference back plus my £200 excess, if not then the law firm dealing with uninsured losses & personal injury will be getting some more work to do!

I was only really trying to highlight the fact for Dave (Silverzipper) (if what I said is correct, as I say he needs to check it out if he wishes) that he can decide if he wants them to take the bike, not the other way around.

If what I have been told is correct then I feel with the boot being on the other foot so-to-speak, that Dave imo is in a better bargaining position for the final settlement, rather than the insurers calling all the shots :!:

I wasn't having a dig chuck, maybe I should've reduced the quote somewhat.

What I was trying to clarify was the "they have no right to take your vehicle, but they often try" bit.

As far as I'm aware, and certainly no expert; Your own insurers can refuse buy back if they're paying out, just not sure about the bit your mate told you, although I'm sure I'd heard summat like that meself.

What happened with my mate was his car got hit by another car while his was parked. Luckily someone who knew him saw it happen, otherwise he wouldn't have known who did it. Eventually their insurers were informed and they've decided to pay up. My mate was worried his car would be written off and taken off him, but according to his insures they can't do that, although they may try.

As you say, if you make a claim on your insurance they can take your vehicle although some will allow you to buy it back if you wish, but not all :!:

Here's a good one....

Years ago me bro was visiting a friend and parked outside his house, at night on a well lit and very quiet suburban street. There's no major road or through route within 1/2 a mile or so.

One of the neighbours across the road, reversed his car out of his driveway, across the junction and 'went a bit too far'! reversed into the side of me bro's car damaging the rear door and rear wing.

Thankfully he knocked on the neighbours door and apologised, admitted it was his fault "no sh1t Sherlock!' and exchanged details with me bro.

The insurance companies went knock for knock! Unbelievable, but true! needless to say me bro was flabbergasted to say the least, the air was blue!

No matter how much he argued with his insurers at the time, they wouldn't budge even though the guy had written in his statement that he was solely to blame.

I believe that the insurers have an 'old boys' type network and exchange favours, you scratch my back on this one, we'll scratch yours on that one and so on.

The problems I've had with mine are still ongoing, even though they've paid me out. It deserves its own thread, and when it's all over, will get one. For now, just avoid KGM!!
