Under fairing and engine is looking good - rear wheel off tonight, shims being checked / adjusted on Wednesday. Progress is being made.
As an aside, I've had an e-mail from Consumer Direct. Just in case any of you get into the same mare that I have, this is what they have said:
Your legal rights in this instance are against the seller from whom the goods were purchased. The legislation that would cover you is the Sale of Goods Act 1979 (as amended). Section 13 of the Act states that goods should be as described. If they are not, then the seller is in breach of contract and you could request a full refund.
At this stage, I would advise to send the trader that sold the goods a recorded delivery letter (keeping a copy). After providing an account of the events you should refer to your rights under the Sale of Goods Act and allow 14 days for a refund or other appropriate remedy to be arranged. If the letter does not prove successful then you may need to take action via the Small Claims Court.
The Seller might also have committed an offence under the Consumer Protection Regulations if the goods are mis-described.
