E bay .

Hi all i recently bought some R1 mirrors off E bay , they were advertised as used in good condition , they turned up today and one looks like it is an aftermarket mirror,but in good nick so i can live with that,but the second is scratched to Sh*t and one of the threads is snapped off , the item wasn't advertised as damaged where do i stand ?

I e mailed the guy and he says he doesn't think it was that bad,it came off his bike (smashed to sh*t probably) and considering the cost of mirrors blah blah i got a good deal.

I asked for partial refund and want to leave negative feedback ,refund looking unlikely ,what would you do ?

Any advise appreciated.

If you paid through paypal, file a dispute, you only get 30 days after auction end to open a dispute claim up though....or contact ebay, as item was not as described.

Ok thanks, i just didnt want to get negative feedback left for me, after i leave it for him ,as i have 100% feedback .

Hi, speaking from experience, you are protected by the long distance selling regs and you are entitled to a full refund whether the seller wants to refund or not as long as you paid by paypal! You can put your reason why (damaged/not as described)on the open case. First off, you have to put it into dispute by opening a case and asking for a refund, they have 10 days to reply, even if they say no and close the case,you opt to open another case and still ask for a refund, they have 10 days to reply again, and in the meantime you wait the 10 days. If you have not heard anything back by the 10th day then Ebay refund you in full and that happens within 3 days, although I got my £225 back same day into my paypal, even though the seller had flat refused me a refund. Do not be temped to get into any kind of heated debate or leave neg feedback.Just leave it and don't do any feedback at all cos when you open a case on the seller, anyone else looking at their account, can see it and the notes you add to the case.

So long as you paid by paypal, you're laughing. Get your money back and shop elsewhere. Hope this helps. :thumbup:

Sellers cant leave neg feedback for buyers any more...........get ripped into him.

he wont get paid until you leave + feedback.
paypal are useless unless you paid more than 15 notes.

Well just tried to open a dispute and the automated message came up with paypal cannot open a dispute ,contact seller and try to resolve it with them ,which i have, and he hasn't got back to me after asking for a refund .

So i'll either ring e bay or try paypal tomorrow as im too knackered tonight lol. If no joy i'll just Neg him and sod the consequences.

Spot on, i just checked my paypal account and it says payment not completed, (so as you said must be because i haven't left + feedback) this is why i cant file a dispute .

So what now ?, seems a stalemate can't complain because he hasn't received my money ?

Hi You can leave neg feed back he can'tleave neg feed back as a seller.you should be able to open a dispute case.

Don't think the Distance Selling Regulations apply to a private seller and not to an auction anyway. I had a silly issue with a steam wallpaper stripper, described as "as new, ex display" The idiot had nailed it to the display through the water hose, then wondered why I complained and left negative feedback!

Cheers for all your helpful suggestions finally sorted ,Tried to open a dispute but couldn't until he was paid ,so negged him .

Then next day he paid me half the money back which is ok as one mirror was ok ,got another on order as a replacement from wemoto.

Much better vision with the R1 mirrors i can now see behind me and past my shoulders lol.
