Having collapsing to the floor whilst at work with my right hip giving way in december 2008, I've suffered through out 2009 with it and lost money from having to refrain from working. My employer wont reconise it as an accident whilst working for themand have given me a verbal warning for having so much time of work . My doctor has been unable to find out what it was, so appointed me to see the specialist a couple of months ago.
Been of work since November 0f last year now, surviving on ssp and now down to Employment Supplement allowance. £65 quid don't go far when you still have to pay to keep the roof over your head.
She was unable to find the cause so requested an MRi Scan, had to wait nearly 6 weeks for the results of this. Mind you, in the mean time the engine has buggered on the beast so canr't ride her any more now till I can afford for Roger to rebuild it for me.
Finally got letter from hospital to go back and see the specialist middle of next month, couldn't wait so went to back to my Gp to find out the results .
Result of MRi Scan reveals that I have torn my labarum in my right hip joint and an aggravated cyst has developed around it.
My gp told me that he has never known any one to damage this in the hip before only in shoulder joints, and that it would have to be some thing serious to do it.
I now have to undergo surgery to repair this and revove the cyst. Long story short, crutches for around 2 months them reablitation physio for god knows how long afterwards. all this casue I was trying to earn a living hey.
Never mind hey, worst things happen at sea.

have you tried using a solicitor and explain wtf happened?
might be worth dropping acas a line too - it's all done online now.
note that you can claim constructive dismissal even if you haven't been dismissed.
but if for some reason you think th management are being unreasonable or if your job / circumstances have changed, you could enquire about where you stand legally.

i suppose his point of view is you just collapsed at work, not due to an accident at work, but you are entitled to sick leave and time off for medical treatment.
if you have been threatened with dismissal for it then i suggest acas. theyre sh1t hot, and will tell you if you can claim, wont cost you anything.

what's up with the engine??? maybe someone local can help you out?

Sorry to hear your bad news.
On the bright side, at least they have found something and it is treatable You now have proof for your employer you're not a sherker. Like Benny said, find out your rights and see what help you can get.

when you originally collapsed at work, was it recorded in the accident book at all?
if it was theyre fooked.
you could possibly be entitled to claim for loss of earnings, compensation for the injury plus constructive dismissal if they are being arsy with you and have made your life a misery.

Some employers just take the pi$$, i worked for one that wouldn't keep an accident book after a series of accidents on site, one of which i had, but luckily i was ok after a few weeks.

Employer has been dogging it for nearly a year now. Every department manager is saying one thing while the other is denying what was said.
H&S manager has recently completed a 2 month investigation and found the equipment inadequate for the job and work area moddifcations are required. Best thing about that is I gave her a live demonstration in the middle of last year , and still they did nothing about it.
Have been to see a specialist of there choice, turns out to be a physio. Been 2 months with one of these at hospital.
I,ve kept all the e mails that have been flying back and forth since october 2009 and you can clearly see that every one involved is lying or just passing the buck so they dont cop the blame for this.

I have spoken to the HSE over here, who knows the whole story. She did an unnotified visit to them and found some other issues they had to address while she was there . Recently spoke with her and despite her knowing what had gone on where I worked. My manager even lied to her when she asked if there where any problems or issues in his department. Even knowing that there H&S manager had just completed a 2 months investigation and it came to light that the work area does require moddifcations, and he had an operator of work since november with an hip injury.

I have started leagal procedings against my employer, they say I have a very good case. They are trying to get me my wages to be paid while i,m off sick .The final nail in the coffing was that I now require surgery. this proves that I had recieved an injury that was a direct responce due to the bad working enviroment and that I had already complained about it. Having to lift and turn with 21 kg x2 reals for 12 hrs a day have caused the hip injury. Depite knowing about my hip injury, they kept me on this machine and refused to do any thing about it.

torsion & extension it's called. physio will confirm it's the worst type of manual handling for causing spinal problems etc.
lifting over 20kg you technically should be using mechanical aids.
(no, not the type of mechanical aids you catch from sharing sex toys & shaggin rusty robots)
from what you've said i'd say run with it, you have a good case there.
tbh i'd be going for a debilitating injury that's potentially ended your working life.... massive loss of earnings claim. crouton em. not like they give a sh1t about you is it?

Thats been the whole trouble, they do have delmac lifting equipment. There is one lift that is positioned to service 2 machines. However, where it's positioned it serves one machine spot on. But the machine I have to use it dont reach to the furthest edge of the pallet even if you move things around.
You have no choice but to lift the reels off each rewind bar by hand. The upper one is at least head height, while the lower one is about leve with your knees. In one shift you can easy be handling over a ton of weight.
Hense I did my back in and had to have treatment and 8 weeks of work on ssp just before there H&S manager caught me lifting the reels in the middle of last year. Despite showing her , still nothing was done about it.

Just sick of it all. Now i'm claiming employment support allowance I'm hounded by the job centre and have to go to appointments or they stop my allowance. I have to travel to worcester tomorrow to attend a medical examination despite me telling them i require surgery on my hip.

Ps..... What sex life. Very difficult no matter what position we try. Dont even get a goo dnights sleep. I now have to place pillows on my right side so i dont roll over and put pressure on my right hip. Tend to sleep a lot in the day as I'm so tied.
As for the bike, I spoke to roger and explained that I want the engine totally rebuild to sandard spec, he said she will be like new when finished. plus he's going to re do the front forks whils shes in. That is when I can afford to now.
Goverment is on a witch hunt according to my doctor.

If there is a bright side, I guess it's the fact that they have now at last found out what the problem is.

Well seen the specialist now, not looking to good. I,ve been told i,m to young at 49 to have a hip replacment as they only like doing this for old people, there not going to operate and fix the labarum tear I have or remove the cysts in my hip joint socket.

I have 2 options open to me, 1--- take pain reliefe for the rest of my lifes until I get old enough to have a hip replacment or 2---I have the cortisone injection into my hip joint and see if that cures the problem.

They told me I could have had this problem from when i was younger and that my job has more than likely brought or caused arthrites in my hip earlier than it should have done.
I find this strange as I,ve never suffered with any problems like this before , and I,ve certainly never been to the doc,s regarding any problems.
I think they got wind of my claim thats in progress , as they seemed to clam up when they knew about this.
I know have to wait nearly 2 months before they can get me in for the injection. Just hope the pain that it causes is worth it.

Dont know how you can push this but a mate of mine has had a hip replaced and he wasnt quite 40, perhaps it depends on the area health authority policy. He needed it after falling off a bike playing silly buggers, so an injury like yours is surely far more "worthy".

Have just spoken to the Mrs. she is an ex ITU sister, she reckons you need a second opinion after all you have years of tax producing life ahead of you (depressing that one!) or sitting about costing the country a fortune.

Mike, i,v read all about the injections and they say that the worst place is the hip as it,s so far in and depending on how bad the joint is, it will have to be injected all the way around the ball of my thigh bone. Dont like needles at the best of times, plus I know what it felt like when they injected me for the MRi scan. Lost the use of my leg for nearly a week afterwards. Lets face it, being injected into you groin is not the best of places.

Well i,m going back to the doctor on the 9th sep and see what the report from the specilaist has to say.
I,m gonna push him for the replacement. After all he was the one who said I was to young to go on to dissablility in the first place. He even told me he has people in far less shape than me on the dissablility , so I think that takes the piss.

The thing that really gets my goat is that i,ve been suffering with this for nearly 2 years before it went to a specialist to find the problem.


Ohhh by the way, if they put me on dissablility, can I ask for a motorcycle instead of a motorablilty car.
