Marvelous.

Riding to a friends house today through quite a built up area, it had just started raining lightly, a mini pulled out from where it was parked on the right hand side of the road and straight beside me. Front wheel locked dropped the bike on it's side and I was sent cartwheeling down the road.

The police didn't as me anything more than which way were you travelling and how fast. I said I must have been doing 20-25 because it had just started raining (and it was a thirty in a built up area) the roads were clear though.

Damage to bike: Unknown haven't seen it yet.

Damage to me: Casualty on a backboard, injured knees and wrist, sore all over, no cuts or road rash (thanks Hein Gericke Hard Edge Racing), no head injury (thanks Arai). Ambulance service and Cheltenham general were brilliant.

First thing she said to me was sorry, it's my fault I didn't see you! Bright red bike, headlight on, orange, silver and grey leathers, blue and white arai helmet and red gloves, orange backpack.

Police are reporting her for dangerous driving.

Now I have some questions:
The bike had illegal cans, what should I do? The police haven't mentioned it at all.

I'm assuming that it's all going to be her fault, so will her insurance cover my helmet, gloves, boots, watch, ipod and bike?

What about my knackered knee, I'm on crutches at the moment?

Cost of accident so far:
New leather trousers (knee protection knackered) - 140.00
Helment (Arai Haga Replica) - 499.99
Gloves - £30.00
Boots - £70.00

Got to go to the doc's tomorrow to get checked over again and signed off.

Harsh one Matt - hope the bike's ok. Not much advice for you as the Gardai usually take a completely different view to things over here (generally it's the bikes fault :roll: ). Wishing you a speedy recovery.

Ok, i'm assuming you're UK Mainland (ie, normal uk insurance rules)

Yup the cans could be awkward if the police carry out full investigations. Hoever, i'm judging by your description that this wasnt a major incident, so they prolly wouldnt... best option is fingers crossed in that respect. Your only problem is the insurance. If fully comp, the insurance will send an engineer out to inspect the damage, and will note the cans in his report. The ins. co. could then refuse cover if they're not notified of any mods.

With regards to the other party, yep in a word. They will cover all damaged items, but most likely they will want to see them, either offer to send them in to them, or provide full colour photos of all damaged stuff, or offer for them to send an engineer to see it all. They may ask for recpts, but if you dont have, try to get replacment estimates. Expect to get a deduction for wear & tear, (only fair, unless the stuff was all brand new).

You will also be able to claim for injury and any cost incurred in that respect, so keep records of everything this costs you, when you visit your GP etc, etc....

Hi essexbloke,

The police had the bike recovered to a local garage but haven't said anything about the exhausts, he did stress they weren't seizing it just getting somewhere safe.

I tried to contact them this morning but all I got was the standard "can't give you any information on the other driver becuase of the data protection act you'll need to wait for the officer to contact you"

Harsh man.
The Police usually use a local recovery company, that is who will have your bike. As said before they won't look at it, it will rest until either you or your insurance pick it up. Should be fine, long as your ins dont mind the cans, doubt the police will take much interest. Mine cartwheeled and had to be recovered from up a tree but was just recoverd and stored for insurance assesment.

Rest up and I hope your back on your wheels ASAP...

Getting the bike back this PM hopefully. Then I can have a proper look at it.

Helphire is offering a VFR-800 if it's too bably damaged.

THe police have said they aren't interested (except they want to see my insurance cert and MOT). Pretty standard stuff.

The other parties charge has been lowered to careless driving from dangerous driving - which I'm actually quite pleased about, dangerous driving usually means there was some kind of intent, this was purely an accident.

Bennetts have been great, so far, (I suppose this is in part because it's a non-fault accident), I've spoken to a solicitor, helphire all within 3 hours of the initial call to bennetts.

Just got to see the doctor this PM and hope that they say its ok for me to ride/drive, leg's feeling better than it was but still really sore and massively swollen. Shoulder is stiff and painful and wrist is swollen.

Can't recommend the Hein Gericke gear enough, according to the CCTV footage, the traffic cop said I did a complete cartwheel/sommersalt type thing and landed on my right knee and left arm, the bike just span off down the road on the crash bung scuffing up the tank, zorsts and fairing. Apparerntly the gear selector is knackered and might not select - which will be a real blow.

Thanks for the advice all - will let you know how it goes.

CCTV footage - excellent - that will help you in your case no end. When I had my accident, the driver atmitted liability etc but when it came to settling the case they were pointing the finger at me! Thankfully I had a witness who's statement made the difference which is why I got all cost recovered. CCTV is even better!

Send us a copy if you have it ;-) sounds pretty spectacular

I doubt the council would let you personally have a copy of the CCTV footage, but, tell the solicitor about it, they can apply in writing for a copy. (may then let you have it upon conclusion).

Who is your Solicitor?

Have you contacted the third party? or Insurer? could give them aring, to see if they're accepting liab. Would help get things moving....

My solicitor is one that Bennetts arranged for me, I didn't catch the name when they called earlier but they are putting everything in the post for me.

Re: the third party, she made the cardinal sin of appologing for five minutes whilst blubbing into her hanky. I haven't spoken to the third party at all, I've left that to the solicitors to sort out, but she did send me a text message telling me that the bike wasn't damange that much. I think she was hoping for a settlement without the insurance being involved, but with all the damage done to both kit, myself and bike she is going to have to think again.

if she's texted you, you have her No. give her a ring, or text her asking for her ins details, then give them a ring to chase up....

otherwise, as great as Solicitors are, these things do tend to drag out...if you go direct, (assuming the Ins are accepting liability) it will deffo speed it all up & get you back on the road quicker (with new gear)

(the injury elelment will need to stay with Sols though)

I'm going to give it a try and see if they'll let me have a copy, but I don't hold out much hope. Worth a go though.

Honda dealer in cheltenham is coming to pick the bike up tomorrow, so should get a full assesment of the damage soon.

Apparently her insurance has admitted liability in light of the police reporting her for the offence. So it looks like it's going to crack on. :)

Sorry to hear about your off Matt. Hope everything goes well with the recovery and claim. Don't forget to also take note of all phone calls, trips (with mileage) for replacing stuff, anything really which is a cost to yourself. It can all be added to the claim through the solicitors :wink:

Glad to hear its all coming together, its also great to see the good advice and experience here in VTR1000.org.

Sound like you might be in Gloucestershire somewhere, if you need a cheap, good, replacement for the 'Storm try Bransons in Gloucester, they will have an excellent condition black one in on Saturday as p-ex and would be glad to sell it on for £2K. I know because its mine.

I've not got any spares apart from an original shock and a part worn rear tyre but you can have 'em if you need.

Can't offer any advice as I haven't had to deal with similar situation, but insurance company might want to check on all the top quality gear you damaged. Apparently most luggage lost by airlines is Louis Vuitton!
